*FEATURED ON THIS EPISODE…*
► 0:30 – Communications when dealing with LTD
► 3:08 – Week That Was – A 48-year-old woman with severe depression caused by the recent death of her sister. She worked as an account executive. Her doctor and therapist disagreed about her diagnosis and this resulted in her LTD insurer cutting off her payments.
► 6:27 – Help@disabilityrights.ca – My LTD adjuster has been harassing me lately. He calls me every week and says he needs more information. If I don’t give it to him, he’ll cut me off. He recently sent a letter saying that my payments will stop soon because I’ve reached the 24-month point. I’m 52 and I’m not ready to go back to work. My doctor says that I still need treatments before I can go back. My husband wants me to appeal, but I’m too stressed to do so.
► 5 Top Mistakes your LTD lawyer should NOT make in handling your claim (but some do):
• 11:55 – Missing the most crucial deadline for starting YOUR legal claim against the insurance company.
• 13:20 – Letting you communicate directly with your insurance company AFTER you’ve retained them.
• 14:15 – Not explaining the legal claim process to you in detail and answering ALL your questions.
• 16:26 – Not getting the NECESSARY medical reports for your case to make sure your case is as strong as possible.
• 18:09 – Settling your case for much LESS than its worth.
► 20:17 – Help@disabilityrights.ca – I was denied long-term disability last year and went to a lawyer who said he could help. But nothing has happened with my claim for a year and a half! The lawyer kept asking for medical documents and contacted the insurance adjuster, but that’s it. I’m worried this may not be the lawyer for me. Is it possible to change lawyers at this stage?
► 23:12 – http://www.mydisabilityquestions.com – My son was bullied and harassed at work and developed severe depression. He has seen several doctors and is taking different medications. After being on short term disability for a few months, he applied for long-term disability but was denied. The LTD insurer, which is different from the short-term disability insurer, doesn’t think that he qualifies for LTD due to “insufficient medical documentation”. How can it be that one insurer says one thing and another says something else?
